New DOMA Lawsuit Filed in Connecticut

Same-sex couples from Connecticut, New Hampshire, and Vermont sued the federal government on Tuesday, challenging the constitutionality of the federal Defense of Marriage Act, which provides that the federal government cannot recognize same-sex marriages even if the marriages are legal in the state where they were entered into.

The case, Pederson v. Office of Personnel Management, is the second time that Boston-based Gay & Lesbian Advocates & Defender (GLAD) has made a federal case out of DOMA. In Gill v. Office of Personnel Management, a federal court ruled in July of this year that DOMA's requirement that the federal government ignore legal marriages from the states violates the federal constitutional guarantee of equal protection. The Department of Justice has appealed the Gill decision to the First Circuit Court of Appeals.
